Venezuela Human Rights Issues

Prison conditions were horrible because of scarce resources, poorly trained and corrupt prison staff, and violence by guards and inmates. The prison-monitoring  Venezuelan Prison Observatory estimated that existing prisons were designed to hold approximately 60% of the estimated 23,300 persons in the national penitentiary system. The OVP estimated that only 34% of the prisoner population was formally convicted, while 60% was awaiting trial.  A lot overcrowding in some prisons and food and water shortages were  problems.

The constitution doesn't permit the arrest or detention of an individual without a judicial order. It provides for the accused to remain free while being tried, except with the specific cases where the laws of the state can supersede this provision. It also provides that any detained individual has the right to immediate communication with family and lawyers who have the right to know of all that is happening.
